The Issues

In March 2025, Nebraska Attorney General Mike Hilgers intensified his efforts against the sale of THC-containing products by issuing cease-and-desist letters to 104 retailers in the Omaha metropolitan area. These letters demanded that businesses immediately stop selling these products or face potential consumer protection lawsuits. This action is part of a broader campaign initiated in October 2023 to address concerns over mislabeled and potentially harmful THC products being sold across the state. ​

 

The Attorney General's Office, in collaboration with the Douglas County Sheriff's Office, conducted investigations revealing that some products sold in these stores exceeded legal THC concentration limits and had inaccurate labeling. Hilgers emphasized the health risks associated with these products, particularly for children, citing incidents of hospitalizations linked to their consumption. He warned that retailers failing to comply within 30 days would face lawsuits seeking maximum penalties. ​ 

This initiative builds upon previous legal actions, including lawsuits filed against retailers in multiple counties and settlements reached with some businesses agreeing to cease sales of THC products and surrender existing stock for destruction. Through these measures, Attorney General Hilgers aims to protect Nebraska consumers from the dangers associated with improperly labeled and potentially hazardous THC products.​
